AGREEMENT BETWEEN USER AND MINDFULLY READY, LLC

Welcome to https://www.mindfullyready.com/ (the “Site”), owned and operated by Mindfully Ready, LLC (“Mindfully Ready,” “Company,” “we,” “our,” or “us”).

By accessing this Site or purchasing any product, service, membership, coaching program, workshop, digital download, or subscription offered by Mindfully Ready, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, please do not use the Site or purchase our products or services.

These Terms apply to all users, customers, members, clients, and visitors of the Site.

SERVICES PROVIDED

Mindfully Ready provides educational and coaching services related to divorce recovery, emotional support, mindset coaching, confidence rebuilding, self-trust, boundaries, personal growth, and co-parenting mindset support.

Services may include, but are not limited to:

  • Digital products

  • Online courses

  • Memberships and subscriptions

  • Group programs

  • Coaching sessions

  • Workshops and trainings

  • Downloadable resources

  • Community access

  • Email content and newsletters

PROFESSIONAL DISCLAIMER

Mindfully Ready provides coaching and educational services only.

Mindfully Ready and its representatives are not acting as licensed therapists, psychologists, psychiatrists, attorneys, financial advisors, medical professionals, or mental health providers.

Nothing provided through the Site, memberships, coaching sessions, workshops, courses, digital products, emails, social media content, community spaces, or other services should be interpreted as:

  • legal advice

  • custody advice

  • financial advice

  • tax advice

  • medical advice

  • therapy

  • mental health treatment

  • crisis intervention services

Participation in coaching or educational services does not establish a therapist-client, attorney-client, fiduciary, or medical-provider relationship.

You acknowledge that you are solely responsible for your own decisions, actions, emotional well-being, legal choices, financial decisions, parenting decisions, and personal outcomes.

If you are experiencing a mental health crisis, domestic violence situation, suicidal thoughts, or require legal or medical assistance, you should immediately seek support from an appropriate licensed professional or emergency services.

NO GUARANTEED RESULTS

Mindfully Ready makes no guarantees regarding personal, emotional, relational, parenting, legal, financial, or business outcomes resulting from participation in any product or service.

Testimonials and examples shared through the Site, marketing materials, social media, or client experiences are individual experiences and are not guarantees of future results.

Results vary based on many factors including personal circumstances, participation, effort, mindset, consistency, and external factors outside of our control.

ELIGIBILITY

You must be at least 18 years old to use this Site or purchase products or services from Mindfully Ready.

By using this Site, you represent that you are legally able to enter into this agreement.

USER ACCOUNTS

If you create an account, membership, or login for any Mindfully Ready service, you are responsible for maintaining the confidentiality of your login credentials and restricting access to your account.

You agree to accept responsibility for all activities that occur under your account.

Mindfully Ready reserves the right to suspend or terminate accounts at our sole discretion for violations of these Terms.

MEMBERSHIPS & SUBSCRIPTION BILLING

Certain products and services offered by Mindfully Ready are subscription-based and automatically renew unless canceled prior to the next billing cycle.

By purchasing a membership or subscription, you authorize Mindfully Ready to charge your selected payment method on a recurring basis according to the billing frequency selected at checkout.

Subscriptions may be billed monthly, annually, or as otherwise stated at the time of purchase.

You may cancel your subscription at any time through your account settings or by contacting [email protected] before your next billing date.

Cancellation stops future billing only and does not provide refunds for previous charges or partially used billing periods.

Access to membership content and services will remain available until the end of the current paid billing cycle unless otherwise stated.

Failed or declined payments may result in suspended or terminated access to memberships, courses, coaching, or digital products.

REFUND POLICY

Due to the digital nature of our products and the live and/or virtual nature of our coaching services, all sales are final.

Refunds are not provided for:

  • digital products

  • downloadable materials

  • memberships

  • subscriptions

  • coaching sessions

  • workshops

  • courses

  • group programs

  • live or recorded trainings

Failure to use purchased products or services does not qualify for a refund.

COACHING SESSION POLICIES

Clients are responsible for attending scheduled coaching sessions at the agreed-upon time.

If you need to cancel or reschedule a coaching session, at least 24 hours notice is required.

Missed sessions, no-shows, forgotten appointments, or late arrivals may be forfeited at Mindfully Ready’s discretion and are not eligible for refunds.

Mindfully Ready reserves the right to reschedule coaching sessions, workshops, or events when necessary.

INTELLECTUAL PROPERTY

All content, materials, products, downloads, courses, memberships, videos, recordings, trainings, worksheets, templates, graphics, logos, text, branding, and resources provided by Mindfully Ready are the intellectual property of Mindfully Ready, LLC and are protected by copyright, trademark, and intellectual property laws.

Your purchase grants you a limited, non-transferable, non-exclusive license for personal individual use only.

You may not:

  • reproduce

  • copy

  • distribute

  • share

  • modify

  • republish

  • resell

  • sublicense

  • upload

  • record

  • teach from

  • publicly display

  • commercially exploit

any Mindfully Ready materials without prior written permission.

You may not share login credentials, membership access, course materials, workshop recordings, or downloadable resources with any third party.

Unauthorized use or distribution may result in termination of access without refund and may result in legal action.

COMMUNITY GUIDELINES

If you participate in a Mindfully Ready membership, group, community, workshop, or online space, you agree to engage respectfully and responsibly.

Mindfully Ready reserves the right to remove any member, participant, or user who:

  • engages in harassment

  • threatens others

  • disrupts the community

  • shares confidential member information

  • promotes hate speech

  • solicits members

  • spams the community

  • violates these Terms

Removal from a community or membership due to violation of these Terms does not entitle you to a refund.

CONFIDENTIALITY

Mindfully Ready values your privacy and aims to create a supportive environment.

However, coaching relationships and online communities are not legally confidential relationships like therapy, medical care, or attorney-client relationships.

Please use discretion when sharing personal or sensitive information in group settings, memberships, online communities, or coaching spaces.

RECORDINGS & REPLAYS

Certain coaching sessions, workshops, trainings, group calls, or community events may be recorded for educational, training, marketing, or replay purposes.

By participating in these events, you acknowledge and consent that recordings may occur.

Mindfully Ready reserves the right to use recordings, screenshots, testimonials, or submitted content for business and marketing purposes unless otherwise prohibited by law.

THIRD-PARTY SERVICES

Mindfully Ready may use third-party platforms and providers including, but not limited to:

  • Stripe

  • Kajabi

  • Calendly

  • Skool

  • email marketing software

  • payment processors

  • social media platforms

We are not responsible for interruptions, outages, errors, security breaches, or functionality issues caused by third-party services.

Your use of third-party platforms may also be subject to those companies’ own terms and privacy policies.

DISCLAIMER OF WARRANTIES

All products, services, content, and materials are provided “as is” and “as available” without warranties of any kind, express or implied.

Mindfully Ready makes no warranties regarding:

  • uninterrupted access

  • accuracy

  • reliability

  • completeness

  • suitability for a particular purpose

  • availability of services

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Mindfully Ready, LLC and its representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the Site or participation in any product or service.

This includes, but is not limited to:

  • emotional distress

  • business losses

  • loss of income

  • relationship outcomes

  • legal outcomes

  • custody outcomes

  • parenting decisions

  • personal decisions

  • technology failures

  • service interruptions

Your sole remedy for dissatisfaction with the Site or services is to discontinue use.

INDEMNIFICATION

You agree to indemnify and hold harmless Mindfully Ready, LLC, its owners, employees, contractors, affiliates, and representatives from any claims, damages, liabilities, costs, or expenses arising from:

  • your use of the Site

  • your participation in services

  • your violation of these Terms

  • your violation of any law or third-party rights

FORCE MAJEURE

Mindfully Ready shall not be held liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to:

  • natural disasters

  • illness

  • internet outages

  • power failures

  • platform outages

  • cyberattacks

  • government actions

  • emergencies

  • labor disputes

TERMINATION

Mindfully Ready reserves the right to suspend or terminate access to the Site, memberships, products, or services at any time and for any reason, including violations of these Terms.

GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of New York, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the courts located in New York.

SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

CHANGES TO TERMS

Mindfully Ready reserves the right to modify or update these Terms at any time.

Updated versions will be posted on this page with a revised effective date.

Continued use of the Site or services after changes are posted constitutes acceptance of the revised Terms.
